1. Overview

Welcome to Go2buy Australia (“Go2buy”, “we”, “us”, “our”). We operate this website and store, including all related information, content, features, tools, products and services (the “Services”). Our store is hosted on Shopify, which provides the e-commerce platform that enables the Services.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy. These Terms incorporate our Returns & Refunds Policy and Shipping Policy. If you do not agree, do not use the Services.

2. Eligibility, Access & Accounts

• You represent that you are at least the age of majority in your state/territory of residence, and you consent to any minor dependants using the Services on devices you own or control.
• You may be asked to provide information (e.g., email, billing, shipping and payment details). You warrant such information is accurate, current and complete, and that you have the rights to provide it.
• You are responsible for maintaining the security of your account credentials and for all activity under your account. You must not transfer, sell, assign or license your account to another person.

3. Products & Content

• We aim to display product information accurately; however, colours/appearance may vary due to device settings.
• Descriptions, specifications and availability may change without notice. We may limit quantities or discontinue products at our discretion.
• Images are for illustrative purposes only unless expressly stated otherwise.

4. Orders & Acceptance

• When you place an order, you make an offer to buy. We may accept or decline any order at our discretion. An order is accepted when we send you an order confirmation.
• Please check your order carefully before submitting; cancellations might not be possible once processing begins. If we decline or change an order, we will attempt to notify you using the contact details you provided.
• Purchases are for personal/household use only and not for resale or export unless agreed in writing.
• Your purchases are subject to our Returns & Refunds Policy.

5. Prices, GST & Billing

• Prices are shown in AUD and (unless stated otherwise) include GST. Shipping and other charges are shown at checkout.
• Prices, discounts and promotions may change without notice. The price in your order confirmation applies to your order.
• You agree to provide current and accurate purchase and account information and to promptly update details (email, addresses, payment method, expiry dates).

6. Shipping, Delivery & Risk

• Delivery timeframes are estimates only and not guaranteed. Delays may occur due to carrier issues, customs or events beyond our control.
• Some orders may not require a signature upon delivery. At the carrier’s discretion, your parcel may be left in a safe place at your delivery address if you are not home.
• Risk of loss and title pass to you once the carrier has delivered the order to your nominated address (including safe-drop deliveries), subject to your rights under the Australian Consumer Law (ACL).

7. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts or modifies any rights and remedies you have under the Australian Consumer Law that cannot be excluded. If a product has a major failure, you are entitled to a replacement or refund and compensation for any reasonably foreseeable loss or damage. If a product fails to be of acceptable quality and the failure is not major, you are entitled to have the product repaired or replaced within a reasonable time. 8. Optional Tools & Third-Party Services

We may provide access to third-party tools or services (including embedded features). These are provided “as is” and “as available” without warranties or endorsement, and your use is at your own risk. Third-party links may take you to websites we do not control; review their terms and policies—we are not responsible for third-party content, products or services.

9. Relationship with Shopify

Go2buy Australia is powered by Shopify. Purchases are made directly with Go2buy Australia, not with Shopify. Shopify is not responsible for transactions between you and Go2buy Australia.

10. Intellectual Property

The Services (including text, images, graphics, logos, audio/video and their arrangement) are owned by Go2buy Australia or our licensors and are protected by applicable IP laws. You may use the Services for personal, non-commercial purposes only. You must not copy, modify, distribute, publicly display, or create derivative works without our prior written consent. Go2buy Australia names, logos and related marks are our trademarks. Other marks are the property of their respective owners.

11. User Content & Feedback

If you submit reviews, ideas, suggestions or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish and display that Feedback in any medium for any purpose. You warrant you own or control the rights in your Feedback and that it does not violate third-party rights or laws. We may monitor, edit or remove content we consider unlawful or objectionable.

12. Prohibited Conduct

You must not use the Services to break laws or infringe rights; harass, abuse or defame; transmit malware or harmful code; scrape or harvest data without consent; misrepresent your identity; interfere with security features; or engage in conduct we consider harmful or that restricts others’ use of the Services. We may suspend or terminate access for violations.

13. Errors & Availability

From time to time there may be typographical errors or omissions (e.g., pricing, availability, shipping charges). We may correct such errors, update information or cancel orders affected by them (including after submission), subject to your ACL rights.

14. Warranties & Disclaimers (Subject to the ACL)

Except for non-excludable guarantees under the ACL, the Services and all products are provided “as is” and “as available”. We do not warrant that your use will be uninterrupted, timely, secure or error-free, or that content will be accurate or complete.

15. Limitation of Liability (Subject to the ACL)

To the maximum extent permitted by law, and subject to your rights under the ACL, we exclude all liability for indirect, incidental, special or consequential loss, loss of profit, data or goodwill, or business interruption, arising from your use of the Services or products. Where liability cannot be excluded, our liability is limited (at our option) to the replacement or repair of the goods, supply of equivalent goods, or the cost of doing so, unless you are entitled to a refund or other remedy under the ACL.

16. Indemnity

You agree to indemnify and hold harmless Go2buy Australia and our officers, employees, contractors and agents from claims arising out of your breach of these Terms or misuse of the Services.

17. Privacy

We handle personal information in accordance with our Privacy Policy. Because our store is hosted by Shopify, certain personal information is processed by Shopify; see Shopify’s privacy materials for details.

18. Changes to the Services or Terms

We may update the Services and these Terms from time to time. We’ll post changes on this page and will notify you of material changes where required by law. Changes take effect from the stated effective date. Your continued use after changes take effect constitutes acceptance.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.

20. Severability & Waiver

If any provision of these Terms is found invalid or unenforceable, the remainder remains in effect. Our failure to enforce any provision is not a waiver of our rights.

21. Governing Law & Venue

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
